A NEW REGULATION COMES INTO FORCE THAT COLLECTS A SERIES OF AGGRAVATED CRIMES
The reform of the Penal Code approved this year by the Government has entered into force. The reform includes a series of aggravated crimes -theft, robbery and reception- that refer to agricultural products and the instruments or means used to obtain them.
With the new regulations there will no longer be a lack of theft, which becomes a minor crime of theft provided that the amount of the stolen does not exceed 400 euros, but with a very relevant feature, regarding the typification. So, will be considered an aggravated crime of larceny, sanctioned with a prison sentence of one to three years the theft of agricultural or livestock products or the instruments or means used to obtain them, provided that the crime is committed on agricultural or livestock farms and serious damage is caused to them.
The same penalty is imposed if the theft is from conduits, cabling, equipment or components of electricity supply infrastructures, hydrocarbons or telecommunications, with what you try to fight, above all, the serious problem of copper cable subtractions. The provision of an aggravated crime of robbery with force in things is equally important if it affects agricultural or livestock products, or the instruments or means to obtain it; sanctioned in this case with a penalty of two to five years in prison.
In relation to habitual criminals, that before could be convicted of simple theft offenses, now an aggravated crime of theft is foreseen, punished with a prison sentence of one to three years, when they have been convicted of three property crimes.
